  • The general terms and conditions are in accordance with the regulations of the Swedish Consumer Agency. These terms and conditions apply to all By Kylie Sweden offers. The terms and conditions are available to everyone.

These general terms and conditions (read: General terms and conditions) apply to all orders, offers and agreements. Unless otherwise agreed in writing with Nexgen Synergie, no deviation from the terms and conditions can be made. Any agreed deviations do not give the customer any rights for future transactions.

Placing an order or accepting an offer means you agree that the terms and conditions apply.

  1. Prices and agreements/dissolution
  • All prices will not be increased during the duration of the offer, unless required by law. All offers are non-binding. All prices on the website are in euros including 25% VAT.
  • All prices and offers are subject to printing and typesetting errors. No liability is accepted for the consequences of these errors. The contract is concluded after Nexgen Synergie has approved your order. The company reserves the right not to accept an order. If this is the case, the customer will always be informed by email stating the reason. If a payment has already been made, it will of course be refunded to the bank account from which the payment was made.
  • By placing an order via the website or by email, a legally valid purchase agreement is created, which must be followed by payment. This agreement can only be cancelled if the customer informs us within 14 days of the conclusion of this agreement that he or she wishes to cancel the purchase agreement. However, the agreement is only cancelled when you receive a confirmation from us by email clearly stating that the order in question has been cancelled.

    3. Shipping and delivery
  • Shipping and delivery will be made while stocks last. Within the framework of the rules of the Distance Selling Act, Nexgen Synergie will to fulfill orders within 30 days. If this is not possible (due to the ordered item being no longer available or out of stock), there is a delay for another reason or an order cannot be fulfilled, or can only be fulfilled in part, you will be notified within 1 month of placing the order and in that case you have the right to cancel the order without costs and notice of default.
  • The delivery location is the address that you have notified Nexgen Synergie as the delivery location.
  • You are responsible for entering your address details. We trust that you will fill in this information correctly. It is not Nexgen Synergie responsibility to check that this information is correct.

Defective product?

  • So annoying! Unfortunately, it can happen that your product is damaged during transport. For this reason, we always deliver a new package free of charge the first time and unfortunately we cannot make any refunds. Will it arrive defective the second time? Then we will refund the full purchase price.

Lost package/returned package?

  • In the event that a package is lost or not delivered due to logistical reasons, we will always send a new package before proceeding to our refund and return policy.
  • If after delivery it turns out that the address details are incorrect, this is at the buyer's own risk. Any additional costs will not be reimbursed by Nexgen Synergie. You can always send us a message so we can find a solution together.
  • Nexgen Synergy will fulfill its obligation to deliver to you, unless proven otherwise, as soon as the goods delivered by Nexgen Synergie has been offered to the customer. In the case of home delivery, the carrier's report containing the refusal or acceptance serves as complete proof of the delivery offer.
  • The prices stated for the products and services offered are in euros including 25% VAT.
  • Our goal is to ship orders within 2 to 5 business days, after receiving full payment, to the delivery address you have provided. If for any reason we deviate from this, you will be notified by email. If you need to collect your package at the delivery location after a delivery attempt, and this does not happen, the package will be returned to us. We will transfer the purchase price back to you less the shipping costs.
  • If a delivery time cannot be realized for any reason, this does not entitle you to compensation, termination of the contract or failure to fulfill any obligation that may arise for you from this or from any other related contract.
  • Partial deliveries are permitted.

    4. Right of withdrawal and return
  • In the case of consumer purchases, in accordance with the Sales or Distance Selling Act (Article 7:5 of the Dutch Civil Code), the customer has the right to return (part of) the delivered goods within a period of 14 days, without giving any reason. This period begins when the ordered goods are presented for the first time at the specified delivery address. If you have not returned the delivered goods to Nexgen Synergie within the specified period, the purchase is a fact. Before proceeding with the return, you are obliged to notify Nexgen Synergie in writing within 14 days of the first delivery attempt. You must prove that the delivered goods were returned on time, for example with proof of postal delivery.
  • Each item should be checked upon receipt for any faults, defects or damage. These must be reported to us within 2 days of receipt, via email. Goods found to be faulty, damaged or defective, and returned without prior notice, will not be accepted by Nexgen Synergie will not be accepted by BNexgen Synergie.
  • If any problems arise, we will try to resolve them as soon as possible. If the solution does not meet your expectations, you can choose to cancel the order at no extra cost. This will be cancelled if:A. The item has been used and/or washed;B. The item is damaged or you have attempted to repair the damage/defect yourself;C. You have not followed the instructions for use;D. The labels and/or accessories are missing;E. The item has been manufactured to your specification(s).
  • You are responsible for the costs of your return shipping, we cannot refund this, unless otherwise agreed in writing. You must pay sufficient postage for returns, we will not accept your return shipment if it is insufficiently stamped.
  • You are responsible for the returned goods. If damage has occurred as a result of improper shipping packaging or if the postal item is insufficiently stamped, we reserve the right to refuse the return shipment.
  • The right of withdrawal cannot be applied to promotional items, discounted goods, accessories, jewelry and other hygiene-sensitive items.

    5. Payment
  • Nexgen Synergy works using online prepayment. After your order, you will receive a confirmation email with information about the total cost, including shipping. There are no additional costs for online payments. Once we have received your full payment, we will ship your order. If a discount code or coupon has been used as payment, no refund can be given and the discount cannot be reissued. The discount code, gift card or other coupons can never be exchanged for cash.

    6. Responsibility
  • All responsibility for Nexgen Synergie and its personnel and products for any damages, regardless of their nature, direct or indirect, including loss of business, consequential damages, damage to movable or immovable property or to persons, is expressly excluded. Nexgen Synergie is also not liable for damages caused by third parties in the performance of the agreement.
  • Nexgen Synergy assumes no liability for damages arising from the use of the articles.
  • Nexgen Synergy liability towards the buyer is in all circumstances limited to an amount corresponding to the invoice amount that the buyer owes Nexgen Synergie in accordance with the current agreement.


    7. Force Majeure
  • In the event of force majeure, Nexgen Synergie has the right, at its own discretion, to suspend the execution of your order, or to dissolve the agreement without legal intervention, by stating this in writing and without Nexgen Synergie being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to the standards of reasonableness and fairness.
  • Force majeure refers to any deficiency that cannot be attributed to Nexgen Synergie because it cannot be attributed to its fault or is due to its negligence in accordance with law, legal act or generally accepted opinions.


    8. Other
  • Nexgen Synergy has the right to use third parties to fulfill your order(s).
  • If you give Nexgen Synergie in writing an address, Nexgen Synergie has the right to ship all orders to that address, unless you provide Nexgen Synergie with a written address to which your orders should be sent.
  • If one or more of the provisions of these Terms or any other agreement with Nexgen Synergie conflicts with any applicable legal provision, the relevant provision will cease to be valid and will be replaced by a new legally permissible comparative provision determined by Nexgen Synergie. 


    9. Applicable law and disputes
  • All rights, obligations, offers, orders and agreements to which these terms and conditions apply are governed exclusively by Dutch law.
  • Any disputes that cannot be resolved without the intervention of a judge will be submitted to a court designated by Nexgen Synergie. 


    10. Pictures and specifications
  • All images, photographs, drawings, etc.; Information about weights, dimensions, colors, images of labels, etc. on the Nexgen Synergie website are only approximate, are indicative and cannot give rise to compensation or termination of the contract.
